In my comments policy I specifically reserve the rights to contact someone directly, but not to add them to any mailing list. Then again, you can also get a spam complaint from people who subscribed to comments on your blog. You might not get taken to court over it, because it is relatively low volume, but it could give you delivery problems. I know a few blogs where I have delivery problems with Gmail.
